Refund & Cancellation Policy
This Refund & Cancellation Policy (“Policy”) governs the circumstances under which refunds, cancellations, or fee adjustments may be considered by Prayal Immigration (“Company”, “we”, “us”, or “our”) in relation to services offered through www.prayalimmigration.com (“Website”).
This Policy forms an integral part of the Terms & Conditions of Prayal Immigration and is incorporated therein by reference. In the event of any inconsistency, the Terms & Conditions shall prevail, unless expressly stated otherwise.
1. Nature of Fees & Commercial Understanding
Prayal Immigration provides professional consultancy, advisory, documentation assistance, and procedural support services.
You expressly acknowledge and agree that:
- Fees are charged for time, expertise, evaluation, advisory effort, and administrative work
- Fees are not contingent upon visa approval or outcome
- Immigration decisions are made solely by foreign governments and authorities
Accordingly, professional fees are earned upon commencement of engagement.
2. General No-Refund Policy (Core Rule)
All professional fees paid to Prayal Immigration are strictly non-refundable once services have commenced, unless expressly agreed otherwise in writing.
For the avoidance of doubt:
- Visa refusal
- Application rejection
- Delays
- Policy changes
- Changes in eligibility criteria
- Quota exhaustion
- Discretionary decisions of authorities
shall not constitute grounds for refund, chargeback, waiver, or compensation.
3. Definition of “Commencement of Services”
Services shall be deemed to have commenced upon the occurrence of any one of the following:
- Initial consultation or eligibility assessment
- Review of documents or profile
- Issuance of checklists, guidance, or strategy
- Communication with the client regarding case processing
- Opening or creation of client file
- Allocation of internal resources
Once commenced, fees are deemed earned.
4. Cancellation by Client / Client-Initiated Abandonment
1. The Client may request cancellation of services at any time by providing written notice to the Company.
2. Notwithstanding such request, the Client acknowledges that all fees charged are for professional effort and procedural support, and not contingent upon outcome.
3. In the event of partial or complete abandonment by the Client:
- The Client shall remain liable for full fees as specified in Annexure B – Fee Schedule
- The Company may adjust directly unincurred third-party costs, if documented in writing
4. No refund, fee reduction, or waiver shall be payable in cases of Client-initiated abandonment, delay, or non-cooperation.
5. This provision is without prejudice to the Company’s right to suspend or terminate services under the Terms & Conditions.
5. Termination by Prayal Immigration
The Company reserves the right to suspend or terminate services without refund where:
- False, misleading, forged, or incomplete information is provided
- Client fails to cooperate or comply with instructions
- Engagement poses legal, regulatory, ethical, or reputational risk
- Client breaches the Terms & Conditions or policies
Such termination shall not entitle the client to any refund.
6. Third-Party Fees & External Costs
Refunds shall not be provided for:
- Government or embassy fees
- Application or filing charges
- Examination, testing, or credential evaluation fees
- Translation, courier, or notarisation costs
- Fees paid to third-party service providers
These costs are governed by respective third-party refund rules.
7. No Chargebacks or Payment Disputes
Clients agree not to:
- Initiate chargebacks
- Raise payment disputes
- Reverse transactions
without first contacting Prayal Immigration. Unauthorised chargebacks may result in legal recovery action.
8. Exceptional Refunds (Discretionary)
- Must be approved in writing
- Shall not constitute precedent
- Shall be strictly case-specific
The Company retains absolute discretion.
9. Limitation of Liability
- Any refund, if granted, shall be the sole remedy
- Total liability shall not exceed professional fees paid
- No indirect or consequential loss shall be recoverable
10. Amendments to Policy
This Policy may be modified or updated at any time and shall be effective immediately upon publication on the Website.
11. Governing Law & Jurisdiction
This Policy shall be governed by the laws of India. Courts of India shall have exclusive jurisdiction.
